We do not collect any other personal information unless you voluntarily provide it.

  • Contact Forms: When you fill out and submit contact forms on our website or voluntarily provide your details to us at conferences, events, or similar occasions, we collect information such as your first name, last name,  email address and, where relevant (such as at conferences or events), your telephone number as well as any other information you provide that could personally identify you.

  • Subscription Forms: If you subscribe to newsletters or marketing communications or voluntarily sign up for such communications at conferences or events, we collect the information you provide in those forms.

  • Other Direct Interactions: We may also collect information during customer service interactions, or voluntarily at conferences or events, or through other direct communications with you.

  • Additional Data Collection: In addition to the information collected through our website or at conferences/events, we may collect limited personal information when you register a product. This may include your first name, last name, and email address, as well as account credentials (such as a username and password) that you create to access the product. We use this information solely to create and manage your account and to provide you with access to the product. We collect this information solely to respond to your inquiries and provide you with relevant information about our products and services. Zinc (individually and collectively, “Zinc,” “We,” “Our” or “Us”) is committed to protecting Your privacy and this Privacy Policy sets out our privacy practices. Please take the time to review this Privacy Policy carefully, as it explains how Your personal information will be handled by us. Depending on the nature of our relationship, Zinc may act as a ‘data controller’ (when determining the purposes and means of processing Your personal information) or as a ‘data processor’ (when processing personal information on behalf of another controller). This Privacy Policy describes these roles to ensure transparency and compliance with applicable data protection laws.

By using the Zinc Reader website at games.zinclearninglabs.com (the “Website”), the Zinc Vocab (the “Application”) and our services (“Services”), You unconditionally agree to be bound by this Privacy Policy. Zinc wants to offer You the best possible Internet experience. Consequently, additional functions, features, products or services are incorporated into the Website and the Application from time to time. THE INFORMATION WE OBTAIN AND MANAGE
The Personal Information that the Zinc may collect from You and/or manage includes, but is not limited to:

  • Your name;

  • Your contact information such as email addresses, IP addresses, and where relevant (such as at conferences or events) telephone numbers, as well as any other information we collect that could personally identify You;

  • Account credentials you create to access the product. These credentials are used solely to create, secure, and manage your account and are stored in an encrypted or otherwise secure format; and

  • If you are a student who joins a school or classroom on the Website that is created by the school You attend, the individual and cumulative scores that You achieve in games and activities that You access and use on the Website (“Your Game Scores”).

Except as otherwise provided in this Privacy Policy, Zinc will store all information provided by You in its secure data servers to the extent necessary to provide the Services to You and/or Your Teacher during the time You are in the Teacher’s class.


HOW WE OBTAIN THE PERSONAL INFORMATION
Zinc may obtain, collect, retain, store or otherwise maintain Your Personal Information from the following sources:

  • Information that You provide to Us when You register to use and use the Website and/or the Application;

  • Information that You provide to Us when you engage in games and activities on the Website and/or the Application;

  • Information that results from You engaging in games and activities on the Website and/or the Application;

  • Information that You provide to Us when You contact Zinc;

  • Information that You voluntarily provide to Us at conferences, events, or similar occasions;

  • Your responses to communications from Zinc. From time to time, Zinc may communicate with You through email, postal mail or other forms of electronic communications regarding the Website and/or the Application, Your use of the Website, the Application and the games and activities which you played or engaged in on the Website and/or the Application; and

  • If you are a student, from teachers, tutors, schools and other educational providers and entities to whom You, your parent or your guardian has provided Your Personal Information and Your parent or guardian has not objected to those third parties accessing and using such Personal Information.

You can decline to provide Your Personal Information to Zinc by not engaging in the activities described above. If You decline to submit Personal Information, Zinc may not be able to or may choose not to provide to You some or all of the features available on the Website and/or the Application or some of the products or services that it offers. 
Where consent is required, Zinc records the date, scope, and method of consent. You may withdraw your consent at any time by contacting us at privacy@zinclearninglabs.com . We will honor such withdrawals promptly, except where continued processing is required by law or to fulfill our contractual obligations to you.


WHY DO WE COLLECT AND USE PERSONAL INFORMATION?
In order to:

  1. Maintain a record of your completion of games and activities on the Website and/or the Application;

  2. Maintain a record of the scores You achieve in the games You play on Website and/or the Application;

  3. Respond to communications that You initiate with Us;

  4. Contact You in order to resolve problems or other issues that You may experience in connection with Your access or use of the Website, the Application or with any goods or services supplied to You;

  5. Send You information about the Website, the Application the games and activities available on the Website and the Application and Your use of the Website and/or the Application and the games and activities available on the Website (if You have chosen to receive such information); and

  6. If you are a student, enable your teacher, tutor or other educational provider to observe Your progress with and completion of the Website’s games and activities.

Zinc collects and uses personal information solely for the purposes described in this Privacy Policy. Personal information will not be used for purposes materially different from those initially disclosed unless we first notify you and, where required, obtain your consent. We apply data minimization principles to ensure only the minimum necessary personal data is collected and retained.
We need to collect and process personal information about You. We will ask You for this information through our Website or when You register to use the Website and/or the Application. Certain information is collected automatically, as described later in this Privacy Policy.
Although We do not make it compulsory to give us every item of information We ask for, the more information You volunteer (and the more accurate it is), the better We can tailor our services for You.
Zinc restricts access to Personal Information to those employees, contractors and agents of Zinc and other persons described above whom need to access Personal Information for the purposes specified above. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination, if they fail to meet these obligations.
If You are a student, Zinc may provide Your Personal Information to Your Teacher. Other than the provision of students’ Personal Information to their respective Teachers, Zinc does not provide Personal Information to third parties.
Zinc does not to collect, use, or share Your Personal information for any purposes beyond those set for this in agreement nor does it use Your Personal Information or interaction with the Website for the purposes of advertising or behavioral marketing.


DISCLOSING YOUR INFORMATION TO OTHERS
Except as otherwise set forth herein, Zinc does not share Your Personal Information with third parties without Your or, if You are a student, Your parent’s or guardian’s consent, except when We believe that it is reasonably necessary to do so in order to comply with a subpoena or other judicial order or process, as otherwise required by law or in order to enforce Zinc’ Terms of Service. In such circumstances, Your Personal Information may also be disclosed to Zinc attorneys.
If You are a student who joins a school or classroom on the Website that is created by the school You attend, Zinc may provide Your teacher and other personnel from Your school with access to Your name and Your Game Scores.
If Zinc desires to use Your Personal Information for any purpose other than those described in this Privacy Policy, Zinc will request Your or, if You are a student, Your parent’s or guardian’s consent prior to such use. If You, or if You are a student, Your parent or guardian does not consent or You otherwise decline to submit Your Personal Information in response to such a request, Zinc may not be able to provide to You some or all of the features available on the Website.
Except in instances where Zinc provides Your Information to third parties in order to comply with a subpoena or other judicial order or process, as otherwise required by law or in order to enforce Zinc’s Terms of Service, Zinc will only share Your Information with Your teacher and other personnel from Your school.


THIRD PARTY INFORMATION
Zinc may collect or purchase information from third parties (including Teachers) regarding persons who provided information to those third parties. Information provided to Us by the third party may include, but not limited to, individual names, email and, and any other information provided to the third party. Zinc uses its reasonable best efforts to ensure that (i) the third party possesses the right to transfer the information to Zinc and (ii) Zinc has received the right to communicate with the persons who provided the information.


EMAIL SOLICITATIONS
Zinc only sends email solicitation to users who have agreed, through this Privacy Policy, on a third party Website or by other means, to receive emails from Zinc.


HOW LONG WE KEEP THE PERSONAL INFORMATION FOR
Unless necessary to enforce the Zinc’s Terms of Service or if required by law or court order, we do not retain Your Information for longer than is necessary to provide the Services to You. Data retention and deletion will be handled in accordance with the terms specified in our agreements with Your educational institution or other applicable client agreements. Where a client agreement does not specify a data deletion period, and unless otherwise directed by the client, Zinc will delete personally identifiable information (PII) and other account-related data within ninety (90) days following (a) termination of the applicable contract, (b) termination of Your account with Zinc, or (c) notification from Your teacher or educational institution that You or they are no longer using the Services.
At the end of the applicable retention period, or upon verified deletion request, Zinc securely deletes or anonymizes personal information. We use industry-standard methods to ensure data is irrecoverably destroyed, including secure wiping of storage media and documented deletion of backups where feasible.


HOW WE KEEP THE PERSONAL INFORMATION SECURE
Zinc uses commercially reasonable efforts to ensure that such information is secure and to protect against its loss, misuses, and alteration of the information under Zinc’ direct control. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. Notwithstanding the foregoing, Zinc cannot guarantee that its security measures will prevent its computers from illegal or otherwise unauthorized access.
In the event of a personal data breach that creates a risk to your rights and freedoms, Zinc will notify affected individuals and any applicable regulators without undue delay, consistent with applicable laws. Our breach response procedures include investigation, remediation, and communication plans to minimize impact and enhance our security posture.


LOG FILES/IP ADDRESSES
When You visit the Website, We may automatically log Your IP address (the unique address which identifies Your computer on the internet) which is automatically recognized by Our web server. We use IP addresses to help us administer the Website and to collect broad demographic information for aggregate use.

DATA SHARING AND TRANSFERS
Zinc does not sell, rent, or share student personal information with third parties for their own commercial purposes, advertising, or marketing. We limit disclosure of student personal information strictly to what is necessary to operate and improve our reading app and related services.

Third-Party Service Providers
We use secure, industry-leading cloud infrastructure and limited third-party service providers to host and process data necessary to operate our Website and Services (for example, secure hosting or email delivery). These providers act only under our instructions, do not use your personal information for their own purposes, and are required by contract to maintain confidentiality and protect your information.

Onward Transfer in Case of Merger or Acquisition
If Zinc becomes involved in a merger, acquisition, or sale of all or part of its assets, student personal information may be transferred solely to ensure the continued provision of the product and related services. In such circumstances:

  • We will provide advance notice before personal information is transferred and becomes subject to a different privacy policy, giving parents, schools, and users a reasonable opportunity to review or object where applicable.

  • The receiving or successor entity will be contractually required to honor the commitments in this Privacy Policy and comply with all applicable student privacy laws including, but not limited to, COPPA, FERPA (as applicable), and the K-12 School Service Provider Pledge to Safeguard Student Privacy, which can be found at https://studentprivacypledge.org/privacy-pledge/ .

  • The successor entity will be restricted to processing student personal information only for the educational purposes originally disclosed, unless new notice and, where required, consent is obtained from parents, schools, or users.

  • If the successor entity makes material changes to how it handles student personal information, it must provide an updated privacy notice and, where required, obtain consent.

  • All applicable student and parent rights including access, correction, deletion, and restriction, will continue to be honored after the transfer.

  • Opt-Out Rights: Before any transfer of student personal information to a new entity in connection with a merger, acquisition, or sale, Zinc will provide advance written notice to the affected schools, parents, or guardians. Where permitted by law, they will have a reasonable opportunity to opt out of the transfer or request deletion of the student’s personal information before the transfer occurs. Zinc will honor such requests unless retention is required by law or necessary to continue providing the contracted educational services.

Data Location and International Transfers
All personal information is stored and processed within secure data centers located in the United States. We do not transfer personal information outside your jurisdiction except where legally required to do so or to comply with contractual obligations, and any such transfers are safeguarded using appropriate protection.

De-Identified and Aggregated Data
Zinc may share non-personally identifiable, aggregated, or de-identified information about usage of the product with partners. This information will not be linked to any personally identifiable student information and will be used solely for legitimate educational, analytical, or service-improvement purposes.

CHANGES TO THIS PRIVACY POLICY
Zinc is committed to reviewing this Privacy Policy at least once every 12 months, in addition to making updates whenever required by changes in laws, regulations, or our practices. When we revise this policy, including changes to how Zinc uses Your Personal Information, we will update the ‘last revised’ date at the bottom of this web page. You (or, if You are a student, your parent or guardian) will be clearly informed of the changes and will be prompted to review and accept the revised Privacy Policy upon Your next login before You may continue to use the Application or Services. PRIVACY COMPLAINTS AND INQUIRIES
We take your privacy seriously and are committed to protecting your personal information. If you have any concerns or complaints about how we handle your Personally Identifiable Information (PII), you can contact us by emailing privacy@zinclearninglabs.com . This inbox is monitored directly by our Privacy Officer, who reviews all complaints promptly. We respond to all concerns within 72 hours of receipt, and our responses are sent to the same email address from which the concern was raised. All complaints are documented and tracked until resolved to ensure transparency and accountability. Complaints are handled securely, with access limited to authorized personnel only, and our staff receive regular training in privacy and data protection. By following industry best practices, we work to resolve complaints quickly and fairly while maintaining clear communication throughout the process.

If your request is complex or requires additional verification, Zinc may extend the response period by up to one additional month, and we will notify you promptly of the extension and reasons. CHILDREN'S/MINOR'S USE OF THE SITE
Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent. Zinc does not use children’s data for advertising, behavioral profiling, or marketing purposes. This Zinc Reading Labs Terms Of Service and End User License Agreement (the “Agreement”) governs Your use of and interaction with Zinc Learning Lab’s Reading Labs website at www.games.zinclearninglabs.com (the “Website”), the Website’s content, including its text, layout, images and graphics, the selection and arrangement thereof and all associated software components (individually and collectively, “Content”) and the services provided on and through the Website (the “Services”). The words “User”, “You” and “Your” used in this Agreement refer to users of the Website and other persons who access the Website. INTELLECTUAL PROPERTY

“Zinc Educational Services” “Zinc” “Zinc Vocab” and “Zinc Reader” are trademarks (the “Zinc Trademarks”) owned by Zinc. All other trademarks, service marks, domain names, logos, and company names (collectively “Other Trademarks”) displayed or referred to on the Website are trademarks, registered trademarks, service marks, domain names, logos, company names of or are otherwise the property of Zinc or their respective owners. Except as provided in this Agreement, Zinc does not grant You any rights in or to the Zinc Trademark or the Other Trademarks. You agree that You shall not use the Zinc Trademark or the Other Trademarks in any manner inconsistent with the provisions of this Agreement, without the prior written authorization of Zinc or the respective owners of the Other Trademarks as the case may be.

USE OF THE WEBSITE

Without limiting anything else contained in this Agreement, You and Your parent and guardian agree and acknowledge:

The Website and the Content and any other information contained therein are valuable intellectual property owned by or licensed to Zinc and that no proprietary rights therein are being transferred to You by this Agreement;

You will not, directly or indirectly:

  1. Use the Website or the Content and any other information contained therein for any purposes other than Your personal, non-commercial use;

  2. Use the Website or the Content and any other information contained therein to establish independent data files or otherwise amass statistical information thereof or therefrom;

  3. Use the Website or the Content and any other information contained therein in violation of any applicable laws or regulations;

  4. Publish or distribute in any medium the Website or the Content and any other information contained therein, and/or summaries or subsets thereof to any person or entity;

  5. Attempt to access or access any other user’s account;

  6. Attempt to obtain or ascertain or obtain or ascertain any other user’s user name, password and/or personal information by any means whatsoever;

  7. Attempt to elude or elude Zinc’ security systems;

  8. Attempt to gain access to the Website in a fraudulent manner;

  9. Disassemble, decompile, reverse engineer, or otherwise modify the Website or the Content and any other material contained therein;

  10. Use the Website or the Content for any purposes other than those intended by Zinc, as determined by Zinc in its sole discretion; or

  11. Upload or submit any data or information containing any viruses or any computer code, corrupt files or programs engineered or intended to disrupt or destroy the functionality of any software, hardware, telecommunications, networks, servers or other equipment used in connection with or related to the Website, or the downloading thereof.

You and Your parent or guardian specifically acknowledge and agree that any and all misappropriation or misuse of the Website or the Content and any other information contained therein will cause irreparable harm to Zinc and that in such event money damages will not constitute sufficient compensation to Zinc; consequently, in the event that You, directly or indirectly, misappropriate or misuse the Website or Content and any other information contained therein, You specifically consent to Zinc obtaining injunctive relief against You in addition to any other legal or financial remedies to which Zinc may be entitled. Any unauthorized or prohibited use may also subject You to criminal prosecution under applicable laws.

Zinc reserves the unilateral right to discontinue the Website, Your License to download, use and access the Website or the Content at any time, for any reason and without notice. REGISTRATION AND ACCOUNT CREATION

Zinc reserves the right, at any time and for any reason, without notice to You, (i) to deny You access to the Website and any of the Content, (ii) to change, remove or discontinue the Website and any of the Content or services available on or through or the Website; or (iii) to terminate this Agreement.

You may terminate this Agreement at any time by ceasing use of the Website and the Content.   2. Email sent to support@zinclearinglabs.com.

Notices to Zinc shall be deemed delivered when actually received by Zinc.

Any notice or other document or communication from Zinc required or permitted hereunder will be sent to the email address that You provide when You register to use the Website. Such notice will be deemed received by You and Your parent or guardian the business day after the email is sent.

Should You elect to send or receive email communications of any kind to or from Zinc, You and Your parent or guardian represent and warrant to Zinc that Your email service has appropriate and adequate security systems necessary to prevent unauthorized access to outbound or inbound email transmissions.

JURISDICTION; COMPLIANCE WITH LAWS

SUBJECT TO THE MANDATORY ARBITRATION PROVISION BELOW, ANY LEGAL ACTION OR PROCEEDING RELATING TO YOUR ACCESS TO, OR USE OF, THE WEBSITE, THE CONTENT OR THIRD PARTY APPLICATIONS SHALL BE INSTITUTED ONLY IN A STATE OF FEDERAL COURT LOCATED IN NEW YORK, NEW YORK, USA. ARBITRATION

Any controversy or dispute between You, Your parent or guardian and Zinc (the “parties”) concerning or relating to , the Website and/or the Content, this Agreement and/or all matters or issues collateral thereto shall be submitted to final and binding arbitration as the sole and exclusive remedy for such controversy or dispute. Any claim shall be made by filing a demand for arbitration within one (1) year following the occurrence first giving rise to the claim. The right and duty of the parties to resolve disputes by arbitration shall be governed exclusively by the Federal Arbitration Act, and arbitration shall take place according to the Commercial Rules of the American Arbitration Association. The arbitration will be held in New York, New York. Each of the parties shall bear all of its own costs of arbitration, except that the fees of the arbitrator shall be divided equally between the parties. The arbitrator shall have no authority to amend or modify the terms of this Agreement or to award punitive or exemplary damages and the award may be enforced by judgment. Seeking any such remedies shall not be deemed a waiver of either party’s right to compel arbitration.

WAIVER

No delay or omission by Zinc to exercise any right occurring upon any noncompliance on Your part with respect to any of the terms of this Agreement will impair any such right or power or be construed to be a waiver thereof. Any waiver by Zinc of any of the covenants, conditions or Agreements to be performed by You will not be construed to be a waiver of any succeeding breach thereof or of any covenant, condition or Agreement herein contained.

SEVERABILITY

If any portion of this Agreement is adjudged invalid or unenforceable by an arbitrator or a court of competent jurisdiction, the remaining portions will remain valid, enforceable, and in effect.

INDEPENDENT CONTRACTOR

Zinc is an independent contractor; nothing in this agreement shall be construed to create a partnership, joint venture, or agency relationship between You, Your parent or guardian and Zinc.

CONTINUED USE DEEMED ACCEPTANCE

Zinc reserves the right, at its sole discretion, to change, alter, amend or otherwise modify this Agreement from time to time. After any such modification becomes effective, Zinc will deem Your continued use of the Website or any of the Content to constitute Your and Your parent or guardian’s acceptance of and Agreement to such modification.

ENTIRE AGREEMENT
